Appeals court: ACC suit can proceed in NC

A North Carolina appeals court ruled Tuesday that the Atlantic Coast Conference has the right to use the court system in the Tar Heel state to seek the fine the conference wants from the University of Maryland.
The conference wants Maryland to pay a $52 million escape clause as it moves to the Big Ten, and it filed suit to get the money. Maryland officials have argued both that the fine is an illegal penalty and that the case should be decided in a Maryland court.
Tuesday's ruling reasserts the ACC's right to pursue the case in its home state. The decision could be appealed to the state Supreme Court.
The fight over the legality of the fee remains on hold. Maryland is scheduled to begin play in the Big Ten in July.
