Amerson contact with disassociated Leak not NCAA violation

— North Carolina State University confirmed Thursday that cornerback David Amerson and disassociated former player Eric Leak made contact earlier this year.

The school said that communication between Leak and Amerson occurred in June.The contact is not an NCAA violation, but it is a violation of the terms of Leak’s disassociation from the program.

“Eric Leak was notified by N.C. State that he is not to have contact with our current and future student-athletes in all sports for any purpose during the period of disassociation,” N.C. State officials said in a statement. “This ban extends to all forms of in-person contact and all known or future methods of communication. It appears that Eric Leak is in violation of this letter."

Leak was sent a disassociation letter by Athletics Director Debbie Yow last November after he was found to have provided impermissible benefits to two Wolfpack basketball players, C.J. Leslie and Tracy Smith. Leslie was suspended three games last season after an NCAA interview found that Leak provided him with $410 worth of benefits.

Leak admitted to providing $1,349 worth of benefits to Smith.

The terms of Leaks disassociation are stated to last 10 years. However, there is no outlined punishment for violating the terms of the agreement.

Darren Heitner, a former agent who started the website SportsAgentBlog.com, said that following Leak's contact with Amerson, Leak was accompanied by Damon McNair and two other individuals in Atlanta to meet with an agent.

"The interesting thing here is there is this agent, who will remain nameless, decided to travel to Atlanta after talking to Amerson’s mother," Heitner said Thursday while joining Adam and Joe on 99.9 The Fan ESPN Radio. "There has been no indication that Amerson has ever given these individuals authority."

Heitner said that the meeting occurred the same weekend that N.C. State played Tennessee in the Chick-fil-A Kickoff in Atlanta. The timing, however could be coincidence.

"There is nothing that indicates Amerson was involved or even that he knew these guys were orchestrating this meeting," Heitner said.

Leak is not an active agent and told the News & Observer newspaper that his contact was in no way in an attempt to steer Amerson to an agent. Still, the school is covering its bases.

“When we, N.C. State University, know about alleged or actual impermissible athlete-agent activities, we refer such information to the North Carolina Secretary of State Athlete Agent Registration Office,” a statement from the school reads. “Based on the contact made in June of 2012 and in light of the recent article, we are notifying the North Carolina Secretary of State's Athlete Agent Registration Office of this possible violation of the NCUAAA (North Carolina Uniform Athlete Agents Act).”

The Secretary of State’s Office regulates all acting sports agents and requires them to register with the state.

Leak was a wide receiver on the Wolfpack football team from 1997 to 2000. He is banned from leasing football or basketball suites and is not allowed to have any contact with any current or future student-athlete or any employee of the Athletics Department.

    ^ Ken, you also cannot regulate whether or not schools give a proper education to their athletes, either. At some point, the NCAA needs member institutions to do the right thing. Likewise, coaches need their players to do the right thing. And we'd all like people in general (including agents) to do the right thing.

    Unfortunately, not enough people are doing the right thing. So you do your best to regulate what you can. It's unfortunate that the universities, themselves, cannot be trusted to properly educate their student-athletes. The rest is a little easier to accept.

    What this demonstrates, IMO, is the futility of trying to regulate contact with agents, runners and their associates. Universities are basically powerless to prevent a determined agent from skirting the rules.

    Unfortunately, if you can't ban contact, then as a practical matter you also can't control the exchange of money or other benefits under the table. The NCAA needs to get out of the amateurism hole it has dug for itself. But for reasons I have stated before, it can't even do that.

    I think the only way to get any control of this is for federal legislation defining any benefits given to a college athlete as compensation, and requiring anyone who gives such a benefit to report it to the IRS as taxable income to the athlete. At least then any such activity that is concealed by either party subjects them to criminal penalties for tax fraud. The IRS should be further given the right to audit athletes, even when they don't file a tax return, in order to enhance compliance.

    Neither the schools nor the NCAA have any effective enforcement power. It's time to give that power to somebody else.

    Poor unc - they want so badly to have someone else to point a finger at. See - when a potential issue comes up, Yow is way out in front of it. Making a potential story a non-issue. unc - you should take note of that, and shoot - even from A-Rod - once he admitted he took steroids - no big deal.

    Leak is not an agent, and was basically told to stay away from NCState and not have contact with players. Nothing legally binding. AS has been reported repeatedly - his communication with Amerson in no way is a violation of any sort. Yes - Leak dropped some $ for CJL and Tracy Smith (that's not all Leak dropped while he was here....DOH). Hence, his diassociation.

    It's no secret Amerson is going pro. He's a projected 1st rounder.
