If UNC goes, does the judge make UNC pay the $52 Million exit fee?

Here's the judge that didn't dismiss the ACC suit against Maryland:

Education:

Received his undergraduate degree in history, with honors from Davidson College in 1978, was awarded a Thomas Watson Fellowship for post-graduate study abroad in 1979 and received his law degree from UNC-CH in 1982.

Wonder if he'd make the same decision if his alma mater is involved?

Why not? UNC agreed to it, Maryland didn't.
