The objection filed Tuesday by attorneys for former UNC head football coach Butch Davis again delays the potential release of records of his calls on a personal cell phone.

A coalition of media partners, including WRAL News, had set Friday as the deadline for release of the records.

Davis claims the release of records from his "216" phone, which he had from his days in Cleveland, would violate his privacy and that of his contacts, some of whom are high-profile athletes, coaches and businesspeople.

In his motion to quash the media request, he reiterated that neither UNC nor the NCAA found he had done anything wrong. Davis lost his job in July after more than a year of NCAA scrutiny of his program yielded nine allegations of player contact with agents, players receiving impermissible benefits and academic fraud.

The media coalition wants to review Davis' phone records for connections to agents or other evidence that he knew about the alleged infractions by his staff and players.

My question is how long does say Verizon keep the records. Today I was eating lunch with a person who has retired from law enforcement and investigates fraud related to lawyers. He said the phone companies only keep records for a year. It that is the case then Butch is fighting this long enough that those phone calls could be erased. AS I have said in the past. This scandal goes very deep into the heart of unc's athletic and academic over valued programs.

Yes, Davis made the mistake of using a personal phone for work calls, but those personal calls are certainly not a matter of public record. This leads to a very difficult issue. How does a third party (probably will need to be a judge) determine which calls are public record and which are not? A school official calling Davis on his personal phone doesn't make it a work call. They could be setting lunch plans.

Releasing any record of any call that is not clearly work-related will be a severe breach of Davis' privacy.

Conversely. any PUBLIC record in his private phone records that is not released under FOIA sets a bad precedent. We cannot have public officials keeping information under wraps just because they used their private cell phones.

Any citizen has the right to request state records. No one cares to know when Butch called his wife, ordered a pizza, or called a 1-900 love line. And he is free to redact those calls.

You've done a perfectly good job of explaining WHY Davis' 216 calls should be investigated AND why no one cares about the "personal" portions of those records ie pizza delivery , speaking with his wife , loveline , etc. No one cares about ANY of those calls and your critics here KNOW that. They're all scared of the same thing....any revelation of wrong-doing on the part of Butch Davis. Unearthing dirt on Davis means all their support has been wasted and betrayed. It also means even more negative pub for unc. Don't let the haters get ya down. They're perfectly capable of understanding why his 216 calls are now professional calls. They just choose not to. Willful ignorance. Put Coach K and his program under the exact same set of circumstances...right down to the violations enumerated in the NOA. Let it leak that he used a personal cell phone rather than his university-supplied phone to do school business. Duke fires 'im without cause. He's not named in the NOA. The media asks for those "private" records. Oh yeah. I'm 100% sure that unc fans won't be howling! Please. Like I said , don't let the haters get ya down.

I have read most of these, and I commented last week that if Butch didn't have anything to hide that he should bow out gracifully. He received a huge pay-off, and he is still unscathed.

Through my many years, I haven't seen anything quite like this one. There may be some interesting things all coming from the AD's Department on up to the office of Thorp. For the first time; I don't think it's going to be pretty for UNC after this situation.
